COURT SITS LONG ON MOTOR CASE
Although designated "a tempest in a teapot" by counsel for the
defence, Mr. Lilly for the firm of Herchmer, Mitchell & Lilly, the case of
Brown vs. McLeod, heard here by Police Magistrate Leask on the 7th inst.,
lasted until well after midnight on the day named.
The case grew out of a collision of the motor driven by Hedley
McLeod, with the bus of the Brown Stage Line, the scene of the accident
being the Wycliffe road about five miles north of the city. Mrs. Brown,
the plaintiff, brought evidence to show that McLeod had attempted to pass
her car with the result that a strap holding her spare tire had been
wrenched away. McLeod, on the other hand, proved that he had sounded his
horn at intervals for a quarter of a mile on his overtaking Mrs. Brown but
had not attempted to pass until he reached the point of collision, where
the road is forty-three feet in width. The McLeod car suffered a bent rear
mudguard, a fact, the defendant claimed, due to Mrs. Brown having crowded
him into the ditch. His worship heard the greater part of the evidence
patiently but gave no decision until he had personally visited the point of
the accident where he ordered a reconstruction of the scene. Mr. Leask
dismissed the charge after eight hours deliberation, with costs on the
plaintiff. The accident occurred on Tuesday, the 22nd ult.
